
What is Mediation?
Mediation is a private process in which parties to a dispute meet with an objective, neutral professional to attempt to understand and resolve the issues between them. Mediation can be extremely successful in a variety of cases -- particularly divorces and family issues, real estate and land use conflicts, contract claims, and business disputes. Mediation is also used very successfully in personal injury cases and landlord-tenant disputes. The utilization of mediation to resolve complicated real estate development and land use issues is steadily growing.
What Types of Disputes does Mediation Solutions Assist in Resolving?
Mediation Solutions focuses primarily on resolving divorce/family law issues and real estate disputes. We are also qualified to mediate a broad range of civil cases, such as contract, small business, and condominium matters.
Who Pays for the Mediation?
The people or organizations who participate in the mediation process pay directly for the services of the mediator. At the initial session the parties agree upon how the expenses of mediation are allocated between them. It is not uncommon, particularly in divorce cases, that one party pays the full cost of the mediation, or that the expenses are split unevenly in proportion to the available funds of the participants. In most cases, however, the clients split the costs equally. At the initial mediation session the mediator will present a contract which details the expenses of the mediation and the amount each participant will be responsible for paying.
How Long Does Mediation Take?
Mediation can be scheduled quickly and conveniently upon mutual agreement of the mediator and the parties. Many disputes can be resolved in two or three sessions, and most are resolved in five sessions or less. We normally schedule mediation sessions in two-hour time slots.
Can a Party be Required to Participate in Mediation?
No. Mediation is completely voluntary. The mediation can be terminated at any time if a party no longer wishes to continue with the process. However, we find that most people who “test drive” the mediation process usually stay with it.
